Lomic Books maintains a website currently located at www.lomicbooks.com (the “Website”). By accessing or using the Website, including, but not limited to, mobile websites, Lomic Books profiles on social media sites and any other digital services or properties operated or used by the Lomic Books from time to time (collectively the “Sites”) you agree to comply with and be bound by these terms and conditions of use (the “Terms of Use”).

Please read these Terms of Use as well as Lomic Books Privacy Policy. If you do not agree to be bound the Terms of Use and the Privacy Policy, please do not access or use the Sites.

The Sites may contain links to third party websites which are not controlled by Lomic Books. Use of such websites are at your own risk. Lomic Books does not endorse the information contained on any third party website or guarantee the accuracy and reliability of any information on those websites.

The Lomic Books website also integrates or uses third party services in the Sites, each of which have their own data collection policies, use of cookies, privacy policies, and terms of service.  Some of these service providers include: Wix.com, Ascend and  Google Analytics. Lomic Books is not responsible or liable for any data collection undertaken by these providers.  Please refer to their privacy policies and terms of service.

Lomic Books reserves the right to take such steps as it deems necessary, including legal action, to enforce its rights under intellectual property laws, including trademark and copyright law.

No Unlawful or Prohibited Use

By using and accessing the Sites, you agree that you will not use the Sites or any content or information on the Sites for any unlawful or prohibited use without Lomic Book’s prior written authorization. You agree that you will use the Sites for your own personal and non-commercial use. The reproduction, transmission, distribution, sale, publication, broadcast, circulation or dissemination of any information or content or derivative work based on the Sites, in whole or in part, is strictly prohibited without Lomic Book’s prior written authorization.
 
Governing Law

These Terms of Use and all matters regarding your use of the Sites are governed by, and construed in accordance with, the laws and Courts of the Province of Ontario, Canada and the laws of Canada applicable in Ontario.

Termination

Lomic Books may in its sole discretion, and without notice to you, terminate your access to the Sites for any reason. If you are is in violation of these Terms of Use or the Privacy Policy, Lomic Books will not provide notice of termination. Lomic Books is not liable for any damages arising from such a termination.

General Provisions

If any of the provisions in these Terms of Use are held to be unenforceable, invalid or void by a court of competent jurisdiction, such Terms of Use will be restricted or eliminated to the minimum extent necessary and the remaining provisions will otherwise remain in full force and effect. The headings used in these Terms of Use are included for convenience only and will not limit or otherwise affect these Terms of Use. These Terms of Use constitute the entire agreement between you and Lomic Books relating to your use and access to the Sites. Any failure by Lomic Books to take action or insist upon strict performance of any provision in these Terms of Use does not constitute a waiver by Lomic Books of any provision or right.

Lomic Books collects Personal Information provided orally, through email, fax, in person, website forms or through any other means of communication to Lomic Books. Personal information may be collected directly from customers or from other sources. Types of information the Lomic Books collects includes, but is not limited to, names, addresses, email addresses, billing and account information, and information related to book purchases. Lomic Books uses third party service providers to collect information including email marketing providers, website service providers, and other tech providers.  

How Lomic Book  Uses and Discloses Personal Information

Whenever possible, Lomic Books will only use and disclose Personal Information to the extent that is necessary and appropriate to provide quality customer service, marketing and sale of books. Lomic Books does use third party service providers to store consumer data.  Lomic Books does not sell customer information.  
 
Access and Rectification

You have a right to access to your Personal Information and to request a correction to it if you believe it is inaccurate. If you have submitted Personal Information and would like to have access to it, or if you would like to have it corrected, please contact us using the contact form on the Lomic Books website.

Changes to the Privacy Policy

This Policy may be amended by Lomic Books. If such amendments are made, the amended Policy will be posted on our website.
